“Moralius®” application (hereinafter the “Application”) is an application for Android and iOS operating systems installed on a mobile phone or tablet, which was developed and owned by the Private Capital Company under the name “MORALIUS PCC” and the distinctive title “MORALIUS”, with G.C.R. number 152736609000 and based in Maroussi, Attica, at 115 Neratziotissa street (hereinafter referred to as “Moralius””).
By accepting the following terms and conditions of use and installing a copy of the Application on the mobile phone or tablet, the user is provided with the non-exclusive, non-transferable, freely revocable license to use the Application for personal and non-commercial use.
At the same time, by accepting the following terms and conditions of use, which constitute a legally binding agreement (hereinafter the “Agreement”) and starting to use the Application, you acknowledge and agree to your registration in the “Moralius” service (hereinafter the “Service”).
The application is addressed to companies – businesses and their employees – associates, which wish to make use of the Application and is designed to provide facility management services, otherwise Media/Facilities management services.

In other words, it is an activity that incorporates multiple principles in order to ensure functionality in a building complex where people, machines, buildings and finally technology in any form coexist.
By installing and using the Application, you agree that you have read, understood and agreed to the terms and conditions of this Agreement, including the Privacy Policy and the Special Disclaimer, which are posted in the Application.
Moralius reserves the right to amend and terminate this Agreement, at any time and for any reason. In this case, the Last Amendment Date under the heading will be updated and you will be notified with a relevant notice in the Application or by email. Use of the Application after the Last Amendment Date implies acceptance of the amendments.
The company, which is a client of Moralius PCC, enters on the platform the full details of the space which will be the project. It then enters on the platform the full details (i.e. Name, Email, Tel., Mobile 1, Mobile 2, Date of Birth, Home Address) of its employees – associates, who are connected to it either by an employment contract of by a project contract, or by a contract for the provision of independent services and are employed in the space designated as a project.
The Application, when installed on a mobile phone or tablet with iOS or Android operating system and activated, records the entry and exit of the employees – associates of the company in the space which has been defined as the “project” and within a radius of 40m from that space and informs the project supervisor accordingly, who has also been appointed by the company.
In particular, when starting the application, the user is prompted to enter their mobile phone number, which is immediately cross-referenced through the application to their full details, which as mentioned above have already been registered on the platform by the company. After confirming the details, the user’s name appears on the screen of the mobile phone or tablet.
The Application collects primary data from the sensors of the mobile phone or tablet device, exclusively for the period of time during which the user is within the above radius of the project.
Such data are mainly the following: the date and time of the recording for the primary data, the time of the recording in the UNIX time system, location data – GPS (longitude, latitude and altitude of the vehicle, horizontal and GPS recording altitude accuracy), mobile phone or tablet device data, Push Notification Token data, Sign in/ Sign out data, project entry/exit date and time data, data on the date and time of activation/deactivation of Location Services (GPS), data on the time and date of activation/deactivation of the mobile phone or tablet device, data on the time and date of activation/deactivation of the application log from its settings, data on the time and date of activation/deactivation of automatic refresh services in the background (Background App Refresh), data on the time and date of WiFi activation/deactivation.
Upon leaving the project and when the user has left the 40-meter radius, the application does not have access to any of the above data. Similarly, when deactivating the application, the above data cannot be accessed.
The Application is compatible with Android 11 or later and iOS 14 or later. For smartphones that support iOS, the Application is compatible with iPhone 11 and later.
You may install and use the Application and access the service only if a) you are a Moralius PCC business – client, b) for as long as you are affiliated by an employment contract or project contract or an independent service contract with a Moralius PCC business – client and the latter has entered your full details on the platform. Only one account per user is allowed.
By registering in the Application and using the Service, you give your explicit consent and agree to: · Provide true, accurate and up-to-date information about what you are prompted to complete in the application · Not use the Application (i) for any unlawful purpose, (ii) for commercial or advertising purposes, (iii) to distribute any content that is defamatory, obscene, annoying, offensive or threatening (iv) for sending unsolicited mail or other spam (v) to transfer files that contain malware or other malicious software (vi) in any way that could damage Moralius’s reputation. · Comply with all technical restrictions of the Application. •It is expressly prohibited to circumvent any technical limitations of the Application software, use it in any way that is damaging or detrimental to the security measures and the effectiveness of the Application, decompile or reconstruct the source or object code of the Application software, create multiple copies, distribute or disclose any part of or the entire Application software and disclose Application passwords to any third party, not authorized by Moralius.
In the event that any information provided by you is not true or accurate, or in the event of a breach by you, in the sole discretion of Moralius, of any provision of this Agreement, or in the event of non-payment by the business-client of the agreed fee, Moralius has the right to refuse the registration of the respective user and/or immediately suspend or terminate their access to the Application and the Service and refuse any use, present or future, of them, without notice and having no liability for any reason. Moralius further reserves the right to change, without notice, the Service, stop providing the Service or features of the Service, or impose restrictions on its use. Finally, in order for the Application to collect the above primary data, the Google Maps API service is used. Therefore, by installing and using the Application, you agree that you have read, understood and agreed with the “Google Maps and Google Earth Additional Terms of Service” posted on https://www.google.com/intl/en_US/help/terms_maps.html as well as with Google Privacy Policy (https://policies.google.com/privacy).
The Service and the license of the Application for personal and non-commercial use are provided to the businesses – clients of Moralius for an agreed fee and then the users – employees/associates of the businesses are provided with access free of charge. It should be noted that the Application is configured to use WiFi networks in order to transfer the primary data it collects, but it may also use the available mobile networks for these operations, depending on the user’s choice. In the case of using a mobile network, Moralius is not responsible for any charges imposed by the mobile phone company with which you have contracted to use its network.
Moralius informs you that itself or any third parties by its order and on its behalf, will process your personal data, which will be collected by Moralius during your registration in the Application for the purpose of a) serving and supporting the Service, b) sending informative emails or sms for the provision of services through the Application.
The data are kept by Moralius for as long as it provides its businesses – clients with its services through the application as well as for a period of one (1) year after the expiration or termination of this agreement.
The personal data of the users (your identification, your contact details) that are entered in the platform by the clients – businesses are kept for a period of one (1) year from the termination/expiration of the agreement. The recipients of the data concerning the information that Moralius is obliged or entitled to disclose by law or court decision, in case of registration in the Application and the Service, are the supervisory authorities, the judicial authorities, the public officials or any third parties (including the companies affiliated with Moralius), within the framework of their responsibilities, for the execution of the Agreement, the compliance with a legal obligation and the defense of the legal interests of Moralius. In order to fulfill the above mentioned purposes of processing your personal data, your explicit consent in the relevant field of the registration form is necessary. Failure to provide consent, as well as any withdrawal of your consent in the future will result in the immediate cessation of use of the Application and your access to the Service, because by withdrawing it the operation and execution of the Service by Moralius becomes impossible. In any case, you have the right to withdraw your consent at any time, without prejudice to the legality of the processing based on the consent before its withdrawal. You have the right to request Moralius access to the personal data that Moralius holds about you, as well as request that Moralius correct, delete the data and restrict their processing. You also have the right to request the receipt of your personal data in a structured, commonly used and machine-readable format, as well as the right to transfer such data to a third party (data portability right). To exercise the above rights, you can send a letter to Moralius or contact us via sales@moralius.eu.
Moralius shall take all appropriate technical and organizational measures to ensure the confidentiality, integrity and security of the personal data collected by the Application within the Service, including their pseudonymisation and encryption. Nevertheless, Moralius cannot guarantee the confidentiality of this personal information regarding factors beyond its control. Regarding the personal password, it is noted that you are solely responsible for its safe storage and management and you should not disclose it to any third party. Moralius will not be liable for any damage caused by your disclosure of your password to third parties and/or in general by any unauthorized use of your account. If you suspect your Application account has been compromised, you should contact Moralius at sales@moralius.eu as soon as possible.
Use of the Application and Service is provided “as is”, including, but not limited to, any guarantee of ownership or suitability for a particular purpose or non-infringement. Moralius does not confirm or assume responsibility for the accuracy or reliability of the primary data collected by the Application. Moralius does not warrant that (a) the application will be unfailing, (b) any defects or errors will be corrected immediately, (c) the Application is free of viruses or other harmful components, (d) that the Application will operate continuously according to its purpose and specifications or when the coverage of the WiFi or mobile network and/or the mechanical part of your device do not work properly. Moralius does not endorse, accept, guarantee or assume responsibility for any product or service advertised or offered by third parties through the Service or any hyperlink to a website or service, and Moralius will not be a contracting party in, or monitor in any way, any transaction between you and third suppliers of products or services. Any content downloaded or otherwise obtained through the use of the Application has been downloaded at your own risk.
Moralius, its legal representatives, directors, employees or licensors will not be liable for any damages or losses of any kind to you for any failure, error, interruption in the provided Service or non-operation of the Application according to its specifications. Your sole compensation in the event of failure, malfunction or non-operation in accordance with its specifications will be your claim for remedying the issue or correcting the information provided by Moralius.
Moralius, its legal representatives, directors, employees or licensors will not be liable for any damage, loss or harm caused by the infringement or other unauthorized access or use of the Application or your account or the information contained therein. This limitation of liability applies either in the event that the alleged claim is based on the Agreement, on a tort, negligence, objective liability, or on any other basis as well as to the maximum extent permitted by law in any applicable jurisdiction.
The Application, including the algorithm on which it operates, the entire material of the Service contained in the Application, as well as all relevant intellectual and industrial property products, including, for example, trademarks, images, graphics, texts, etc., constitute Moralius intellectual property, which is protected by the applicable law and in particular by the provisions on the protection of intellectual property, the protection of trademarks and the provisions on unfair competition. You are only allowed to install and use one copy of the Application and no other rights are granted to you.
This agreement, together with any amendments and additional agreements that you will enter into with Moralius in relation to the Service and the use of the Application, will constitute the entire agreement between you and Moralius regarding the Service and the use of the Application. Should any provision hereof be declared invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the other terms hereof, which will remain in full force and effect. This agreement and any rights and authorizations granted under it may not be transferred or assigned by you. Any attempt to transfer or assign in breach of this agreement shall be void. Any waiver of any term herein shall not be construed as a waiver of any other term, and any omission by Moralius to exercise any right or hereunder shall not constitute a waiver of such right. This agreement is governed by Greek law and the competent courts for the resolution of any dispute arising from it are the competent courts of Athens.
